Are you a craftsman, trader, entrepreneur and want to open your online shop? Yes, but that's it… You don't know what to do. Thankfully, here are the formalities not to zap before you start e-commerce.
1. Report your site to CNIL
All online sales sites must be reported to the CNIL (National Commission for Information Technology and Freedoms) if they:
- collect personal information (phone numbers, emails, etc.),
- and form databases (customers, prospects).
With some exceptions, this statement is simplified. It is free and can be done online.
2. Submit a domain name
Once your domain name is found, make sure it's not already taken and then drop it off. You don't have to, but you'll be protected in case another site chooses a domain name (too?) close to yours. Or just added an extension (.biz, .net, etc.) that you wouldn't have booked.
3. Write the terms and conditions of sale
If your customers are individuals, certain information should be provided to them:
- Seller identification (your name, phone details, email address, etc.)
- The length of time the offer is valid,
- The total cost of the product or service and any additional costs,
- Payment and delivery terms,
- possible price reductions,
- delivery times and costs (do you have enough inventory and the logistics to ship orders on time?),
- The terms of the right of withdrawal (14 days minimum from the day after receiving the product or accepting the offer if it is a service provided),
- legal guarantees available to your customers (failure to comply, hidden defect),
- contact information of the consumer mediator who will be referred in the event of a dispute.
Good to know
- The user must be able to check the details of his order (in the shopping cart) and change it before accepting it.
- As of June 13, 2014, it is mandatory that the word "order with obligation to pay" be marked before the validation of each order.
Key points to remember:
- You must communicate certain information to your visitors (total cost, delivery terms, etc.).
- If you buy online from a professional, an individual has 14 days to retract without having to justify their decision.
- It is only at the 2nd click that an order is confirmed. And the sale closed.
